Senate, Assembly panels OK new versions of bear feeding bill

TRENTON - State Assembly and Senate committee have approved slightly different bills that would modify the state's current laws on feeding black bears.

On Thursday, [10/10/2024] the Senate Economic Growth Committee unanimously approved tis version - S765 - of an updated bear feeding bill, which generally follows the Assembly version - A360 - approved by that body's Commerce Economic Development and Agriculture Committee. The Senate committee's vote was 5-0 and came Thursday, [10/10/2024] and the Assembly committee's vote was 8-3 and happened on September 12. [2024]
..... The major difference between the two bills is what happens to money paid as fines for those who violate the feeding laws. The Assembly wants fines, which can range up to $1,000, to go to the local municipality where the violation occurred.
..... The Senate bill has penalty funds going to the Division of Fish and Wildlife, as required by state law.
..... Both committee versions replace the term "unintended feeding" with the same list of specific activities, such as animal research, and limits on when licensed cat colonies can be fed.
..... Both subversive also exempt storage by property owners of animal feed, provided it is in a structure with a closed door.
..... The two versions contained the same language that allows for private homes to have bird feeders, but with some restrictions, such as height off the ground (10 feet) and keeping the ground free of seeds and debris, between April 1 and November 20, the time when bears are active.
..... The bills also allow duly licensed hunters and trappers to sue bait for their hunting or trapping activities during the proper season.
..... Since two versions were approved, the bills will return to the appropriate committees to be reconciled and then move though the full Assembly and Senate for approval of the revised language. There is no schedule yet as to when a reconciled bill will be ready.
..... Any approved bill must also be signed by Governor Phil Murphy.
